General terms and conditions

Armin Wurzer pilots and arranges tandem paragliding flights. We exclusively collaborate with independent, experienced, and state-certified tandem pilots who, in the event of a flight, are themselves entrepreneurs of the service and contractual partners of the tandem passenger. The liable contractual partner is the pilot conducting the flight. Liability lies with the respective pilot.

Before the flight, the tandem passenger (in the case of children, a legal guardian or an adult companion) must carefully read the transport contract and confirm it by signature.

Immediately before takeoff, the tandem passenger receives instructions on the takeoff procedures from the pilot. If the tandem passenger does not understand these instructions or is unable to follow them for any other reason, they must immediately inform the pilot.

Flight Schedule and Payment

The tandem passenger declares that their participation in a tandem paragliding flight is solely for personal interest. The costs for travelling to the flying site are to be borne by the tandem passenger. The costs for mountain railway rides and similar expenses are not included in the flight fee. Also, all additional travel expenses that may arise due to weather conditions are also not included in the price. If firmly agreed tandem flight appointment are not adhered to, the entire flight fee is to be paid.

The pilot determines the procedure of the flight. The pilot is also always responsible for conducting the flight.We explicitly point out that despite firmly agreed dates, there is no entitlement to the execution of tandem flights if the prevailing weather conditions in the flying area do not allow it. In the event of rescheduling or sudden cancellation, there is no entitlement to compensation, refund, or reimbursement of any other expenses incurred. However, the right to reschedule the flight remains.

Cancellation due to weather conditions does not need to be objectively proven – the subjective impression of the responsible tandem pilot is sufficient.

The duration of the flight always depends on several weather influences and the desired flying style. Consequently, a uniform flight time cannot be guaranteed. The flight route, landing site, and flight times can be changed at any time, especially for safety or operational reasons, without the tandem passenger having any claim for compensation.

Risk disclosure and flight fitness of the tandem passenger

Despite the utmost care, accidents can still occur during paragliding. Our top priority is to minimize this risk as much as possible.

The passenger agrees to follow the pilot’s instructions in all cases and right away.
The passenger receives theoretical instructions before takeoff. If these instructions are not followed during takeoff, flight, and landing, this can endanger the passenger and the pilot.

The pilot may also exclude the passenger from flight operations if they ignore their instructions. In case of non-compliance, there is no longer any entitlement to carry out the tandem flight, and the refund claim for the flight fee expires. In the event of personal injury due to non-compliance with instructions, the passenger is liable. The passenger is also liable for intentional or grossly negligent damage to the pilot’s equipment or third parties.The passenger expressly declares to be physically and mentally fit and confirms that they feel capable of handling the demands of the flight. In case of doubts about flight fitness, the passenger must inform the tandem pilot before the flight.

The pilot must be informed before the flight in case of:

Restrictions in the musculoskeletal system,
diseases of the heart,
diseases of the spine, and high blood pressure,
tendency to seasickness,
mental or psychological illnesses (drug addiction, consciousness disorders, or similar) within the last 12 months,
alcohol consumption and intake of strong medication within the last 12 hours

Equipment

The tandem passenger undertakes the tandem paragliding flight only with the appropriate clothing (weatherproof and windproof, suitable to get dirty), ankle-high, sturdy hiking boots, as well as gloves and sunglasses.
The pilots provide tandem flight helmets and flight equipment.

The Photo and Video Package

The quality of the photo and video recordings is solely the responsibility of the performing tandem pilot. In case of failures of video recording devices and cameras during a tandem flight, the costs of the photo and video package will be fully reimbursed, and there is no legal entitlement to repeat the flight and the video or photo recordings. The photo and video material is usually reviewed and checked with the passenger on a smartphone after the flight; if the quality is insufficient, it is up to the tandem pilot to decide whether to refund the price of the photo and video package or not.

Right of Use of Image and Film Material

The passenger agrees that all photo and video recordings made during the tandem flight may be used without restriction by fliagn.com. The copyright belongs to Armin Wurzer.

Right of Withdrawal – Cancellation Costs

Claims for a refund of the purchase price can be made within 14 days of purchase without stating reasons. For this purpose, the voucher must be returned within this period.

The passenger can withdraw from the agreed flight date at any time by written notification (email or WhatsApp). Cancellations up to 5 days before the booked date are free of charge. From 2 days to 24 hours before the agreed date, cancellation costs of 50% will be charged. Vouchers and tickets become invalid with a cancellation and become valid again after receiving the cancellation payment. It is excluded to refund the remaining purchase price. This also applies to vouchers or tickets from distribution partners. For cancellations within 24 hours, the cancellation costs are 100%.

Final Provisions

If parts of any of these terms and conditions are ineffective, the effectiveness of the remaining provisions shall remain unaffected. An ineffective provision will be replaced by the provision that comes closest to the original.By paying the invoice amount, by orally giving a transport order, or by redeeming the flight ticket, the tandem passenger concludes an air transport contract with the respective tandem pilot of fliagn.com. This contract is subject to Italian law. The place of jurisdiction and performance for all obligations is Italy.
